Alternative Dispute Resolution FAQs

9. How do the collaborative / structured negotiation processes work?
Both approaches usually involve the following steps:
>gathering and exchanging all information and documents relevant to the issues to be resolved;

>looking at the possible settlement options;

>a settlement meeting to enable you and your spouse, with the assistance of your solicitors, to reach an agreement; and if the negotiation process is successful, your solicitors will set out in writing the terms of the agreement reached.

>Depending on what is agreed, it may be necessary to go to court to get orders by consent. This is always very straightforward.

There are standard sets of ground rules for both approaches that are designed to lend support to the negotiations.
