Access to Justice

Service provided for subsidiary protection

You can make an application for subsidiary protection to the Minister for Justice, Equality and Law Reform only if your application for refugee status has been refused. The letter from the Minister notifying you of this refusal will also contain an application form, which will enable you to apply for subsidiary protection. If you consider that you may be eligible for subsidiary protection, the RLS will assist you in drafting the application.

Subsidiary protection is protection other than refugee status against a real risk of suffering "serious harm" which consists of:
(a) death penalty or execution; or
(b) torture or inhuman or degrading treatment or punishment of an applicant in the country of origin; or
(c) serious and individual threat to a civilian's life or person by reason of indiscriminate violence in situations of international or internal armed conflict.
