Provision of legal advice to legally aided persons in connection with making an application under the Scheme

The Board is prepared to pay solicitors a fee of €100 for the provision of legal advice in connection with making an application under the Scheme to a legally aided person referred to the solicitor’s panel. The fee is claimable irrespective of the applicant's stage in the international protection process. It is also payable irrespective of the date of grant of legal aid and the fee structure applicable. This includes persons referred under previous versions of the International Protection and/or Asylum and Subsidiary Protection Solicitors Panels.

Solicitors who provide this service to legally aided persons are expected to advise the applicant of the legal consequences of making an application for leave to remain under the Scheme and of proceeding, or withdrawing as the case may be, their application for international protection in the State. The fee is not specifically a fee for completing the application form. It is expected that applicants should be able to complete the form without the assistance of a lawyer. However solicitors are free to help the applicant complete the form if requested by the applicant to do so.
